ABSTRACT
Introduction:
Basing on the amendment of the Act of 6Nov2008 on Patients' Rights and Patients' Rights Ombudsman (PRO) provincial committees for the adjudication of medical cases have been appointed. We aimed to analyze data describing the committees’ activity from 01Jan2012 till 30Apr2013.
Materials and methods:
It was a cross-sectional study covering data gathered and revealed by PRO. The information obtained included the number of: applications submitted (excluding requests for re-examination of the case), returned applications and their reasons, applications that are currently dealt with, investigations completed, requests for reconsideration, completed proceedings with a request for re-examination of the case and committee meetings.
Results:
In the period from 01 Jan 2012 to 30 Apr 2013 the committee received 791 applications. Among the completed proceedings determining the occurrence of a medical event resulted in 60 cases, whereas as a result of dealing with the requests for a retrial for the medical cases it was determined 23 cases. In all 2012, the committee received 404 applications. Among the completed proceedings determining the occurrence of a medical case resulted in 22 cases, whereas as a result of dealing with the requests for a retrial for the medical event was 11 cases.
Conclusions:
An increase in the number of applications can be noticed, which confirms that the idea of starting to set up a committee established by the legislature effects. This provides benefits to both patients and the medical community. A good cooperation between physicians and lawyers is crucial for the development of legal awareness of physicians.
